ARTICLE 2 OBJECT OF THE CONTRACT

Community access provided on a subscription basis gives Participants access to numerous resources. The subscription term is 6 months and there is no automatic renewal of the subscription. It should be noted that the subscription price may also change according to special occasions, such as promotions or other commercial initiatives, reflecting the Supplier’s marketing strategy and sales policies at specific times.

The Libertine Queen community is an online platform created for swinging couples or those eager to enter this world, which includes people eager to get to know and meet other people. The Provider strives to ensure that there are no fake profiles by requiring profile verification, however, it cannot guarantee a real connection between users. The possibility of creating mutual acquaintance depends on many factors, including the time spent within the platform, the ways of communication and interaction with others, personal preferences, and so on. These aspects preclude the Provider from ensuring effective knowledge among users. As a reminder, the community is currently specifically for couples.

WORKSHOP

The Supplier offers the service of Live Workshop on zoom platform or other chosen by the supplier, held by the Supplier himself and/or various professionals in the field of the indicative duration i about 1 hour. To ensure the privacy of the Participants all will have their cameras turned off by default. The Participant will need to verify the date and times when the same will take place in order to take advantage of the workshop that includes online interaction with professionals and possibly in a discussion with other Participants.

CONSULTATIONS

The Provider offers the possibility to purchase the Counseling service lasting about 30 minutes via phone/ WhatsApp or third apps that will be agreed upon. The Participant may or may not wear the mask at his or her option.

ARTICLE 4 DURATION OF SERVICE

After making the purchase, the report is understood to be valid for the duration of 6 months. Access to the purchased Service is permitted as long as the Participant has not exercised the right of withdrawal, requested cancellation, or cancellation is ordered by the Provider for legal or company policy reasons. In case of termination of the subscription by the user, there is no refund. Please note that the subscription does not have automatic renewal. This choice reflects our commitment to transparency and respect for our users. ARTICLE 5 PRICES.

The price of the Services is displayed on the Website in euros. The Supplier reserves the right to change the price, at any time, without prior notice, it being understood that the price charged to the User will be the price indicated on the site at the time the order is placed and that no account will be taken of any changes (upward or downward) subsequent to the transmission of the order.

ARTICLE 6 HOW TO REGISTER FOR THE COMMUNITY

In order to gain access to the community, the User will have to register, through which he/she will have to enter the required personal data. The User is responsible for the accuracy of the same. Upon registration and at the time of data entry, the Participant warrants that:

Upon completion of the registration process, the Participant is required to send a photograph to the electronic address verifica@libertinequeen.com before gaining access to the community. Such a photograph must depict THE PARTICIPANT IN COUPLICATION and clearly show a sign with the nickname selected for access to the Community. In order to ensure clarity, a photograph will be provided for illustrative purposes to guide the Participant through the process. Within 24 hours of receiving the photograph, the provider will proceed with verification and, if compliant, enable the account. Once verified, Participants will be able to access the community using the nickname and password chosen during registration.

Provision is made for the Provider to request, if it deems it necessary, at any time during the validity of the Participant’s subscription, one or more photo/video or video calls in order to verify the authenticity and reality of the registered couples. In the event that a Participant refuses to submit to the video call, the Provider reserves the right to proceed with immediate and unannounced expulsion from the community, without entitling the Participant to a refund of the subscription paid.

This procedure will be adopted with the specific goal of ensuring the genuineness and safety of users, thus confirming our commitment to providing a reliable and authentic environment within the Libertine Queen community.

Photos submitted for profile validation are used solely for the purpose of user identity verification. We take all necessary measures to ensure the protection and confidentiality of these images during the validation process. Only after the period of time required by law, the photos will be deleted in a manner that complies with privacy regulations and current legislation, ensuring that they are not retained in any way or in any medium by the Provider.

ARTICLE 7 PURCHASING PROCEDURE

The User may purchase all of the Services offered for sale within the Site, as described, by following the purchasing procedures set forth in the Site itself. To purchase the Services, the User must follow all instructions given by the Provider. The applicable Terms and Conditions are those in effect at the time of the Order and can be found on this page of the Site. The Contract entered into between the Supplier and the Participant shall be deemed concluded with the Supplier’s confirmation of the purchase. Participant will be notified by Supplier of the registration by means of an email, sent to the email address provided during registration or by such other means as will be promptly indicated by Supplier. Any right of the Participant to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused in the course of the Participant’s registration and access is excluded.

ARTICLE 8 MODE OF PAYMENT

The Participant shall pay the requested price in the manner provided in the Site. In the case of a subscription service, the Participant agrees to pay the subscription fee for the service by authorizing the Provider to charge it to the indicated Credit/Debit Card. In the event that the indicated Credit/Debit Card is declined or cannot be used to settle the subscription fee the Participant will be responsible for any outstanding amounts. If a charge fails due to credit card expiration, insufficient funds, or any other reason, and if the Participant has not terminated his or her account, the Provider may suspend his or her access to the Service until he or she has activated a valid Payment Method.

Upon payment, the User’s browser will be directed to a secure server page with SSL encryption. Only Verotel will be in possession of the User’s data to carry out the transaction and they will not be visible to the Provider in any way.

ART.9 OBLIGATIONS OF THE PARTICIPANT

Violation of the above points could lead to immediate and irrevocable removal from our community resulting in the termination of the account by the Provider, without any obligation to give notice and without the right to a refund of any amount paid in addition to reporting to the appropriate authorities, if deemed necessary.

The Participant or user hereby assumes all responsibility for any content that is unlawful, contrary to decency, morality, or infringing on the rights of others. In case of violation of these obligations, the Provider may exclude the Participant from the Service with immediate effect without having to return the amounts paid, and in addition, the automatic renewal will be deactivated and the Participant will no longer be able to register on the platform.

Furthermore, violation of this policy, whether in public or private settings among community participants, would result in severe disciplinary measures. These could include immediate removal of content, suspension or deletion of the account, without notice and without right to a refund of any amounts paid, as well as reporting to the appropriate authorities if deemed necessary. In the event of inquiries from the appropriate authorities arising from violations that occurred within our community, the Provider agrees to cooperate fully and without hesitation with law enforcement agencies. This includes granting access to the back end of the site. The Provider reserves the right to delete the Participant’s user profile if for any reason it suspects that it does not belong to a person of legal age, without any obligation to give prior notice and without any right to a refund of the amount paid, if any.

The Provider holds full discretion in identifying and determining on the basis of its unchallengeable assessment what may be considered vulgar or inappropriate, as well as the power to remove or not remove certain content without justification or necessary notice on the basis of its unchallengeable assessment.

The Provider reserves the right to delete Participants’ user profiles, if the rules are not met, based on its unchallengeable judgment, without any obligation to give prior notice and without the right to a refund of any amount paid.

To ensure compliance with our guidelines, the Provider conducts careful, constant and daily monitoring, conducted both by our administrators and through the use of advanced technologies, such as bots and other automated tools. These means allow us to ensure that no illicit or illegal activities occur within the community, always working to protect and safeguard our users. However, the Provider assumes no responsibility for the content posted within the community or the content of conversations between registered users. Should we identify through our monitoring or receive reports regarding the presence of inappropriate content, it will be removed. In addition, we reserve the right to take appropriate action against users who have violated our guidelines, which may range from a simple warning to account suspension or deletion, depending on the severity of the infraction.

The Participant attests and acknowledges, concurrently assuming the relevant legal responsibility in civil and criminal law, that:

In any case, the Participant is obliged to provide all cooperation to the Provider in order to properly protect its rights in connection with such legal actions. The Supplier reserves the right to protect itself in court, at its own expense, without prejudice to the right to indemnification to

The Participant agrees that his/her profile and related information may be displayed on Community pages.

It is reiterated that in order to preserve privacy and mutual respect, it is strictly prohibited for Participants to record or capture screenshots of conversations, images, audio, video or live online events in the community. Participants are encouraged to exercise caution with regard to personal information shared within the community, as well as the use of uploaded photos and videos. Although the terms and conditions clearly state the guidelines for the community, please be aware of the possibility of screenshots, etc., and sharing of material contrary to these guidelines. Therefore, care should be taken with what is uploaded and shared. The Provider accepts no responsibility for user misbehavior and any damage that may result.

ARTICLE 10 OBLIGATIONS RELATED TO THE USE OF THE SITE

All Users must use the site by strictly adhering to these “Terms and Conditions.”

The User agrees not to use the site and its services for illegal purposes or contrary to these “Terms and Conditions” of use, or in ways that could damage its functionality, make it unusable, cause overloading, deterioration and/or interference with the use of the same by other Users.

Therefore, the User or Participant may not reproduce, duplicate, copy and redistribute, retransmit including to other websites, transfer or otherwise make available to third parties in any capacity or otherwise use for purposes other than storage and/or consultation the Sites and/or Site Content, without the prior express and formal approval of the Provider. All materials prepared by the Supplier will remain the exclusive property of the Supplier.

ARTICLE 12 DISCLAIMER

The Supplier’s liability is understood to be within the limits of its obligations under these “Terms and Conditions” and the amount paid at the time of purchase.

(a) Confidentiality of information and/or statements contained in communications exchanged between Participants;

b) any damages caused by viruses, damaged files, errors, omissions, interruptions of service, deletions of content, problems related to the network, providers or telephone and/or telematic connections, unauthorized access, alteration of data, failure and/or malfunction of the user’s own electronic equipment;

– The Participant agrees to hold the Supplier harmless from any liability in the event of:

a) breach by its Partner of these “Terms and Conditions” or the representations and warranties set forth herein;

b) claims of third parties that are based on the Participant’s use of the Services offered by the Provider.

The Parties mutually acknowledge that, should one or more clauses contained in these Conditions be deemed null, voidable or otherwise ineffective, such nullity or ineffectiveness will not result in the invalidity of the agreement itself in its entirety and will not extend to the remaining clauses. In such a case, the provisions contained in the clauses that should be deemed null and void or otherwise ineffective will be considered as a commitment made and relevant to the contractual good faith of the Parties.

In the event of legal action against the Provider for a Participant’s conduct, the Provider shall have the right to defend itself and resolve the situation as it deems appropriate. It is critical that the involved user cooperates during advocacy. You agree to hold Provider, including its employees, contractors, and licensors, harmless from any and all claims, damages, suits, prosecutions, demands, losses, liabilities, costs, and expenses arising out of your access to the site, uploading or submitting content that does not comply with “Terms and Conditions” or is in violation of applicable laws or regulations. The Provider shall have the exclusive right to handle, agree or settle claims or legal proceedings for its own benefit without first seeking the permission of the user involved.

ARTICLE 13 FAILURE TO EXERCISE A RIGHT

Failure of the Supplier to exercise a right does not constitute any waiver of its right to take action against the Participant or any third party for breach of commitments. Therefore, the Supplier reserves the right to enforce its rights in any case, within the terms granted.

ARTICLE 14 RIGHT OF WITHDRAWAL

The European Union Participating Consumer acknowledges and agrees that they may cancel their subscription within 14 days of ordering. Notice of withdrawal should be sent by email to admin@libertinequeen.com. Refunds will be made within 30 days of receiving the notice. However, this right ceases once the Participant has used the site after payment. ARTICLE 15 APPLICABLE LAW AND PLACE OF JURISDICTION

These Terms and Conditions are governed entirely by Spanish law. Any dispute arising in connection with the validity, interpretation, performance and termination of these Terms and Conditions shall be subject to the exclusive jurisdiction of the Courts of Las Palmas de Gran Canaria.

ART.16 MAJOR FORCE.

The Supplier shall not be held liable for failure or delay in the performance of its obligations due to circumstances beyond the reasonable control of the Supplier due to force majeure events or, otherwise, to unforeseen and unforeseeable events and, in any case, beyond the Supplier’s control. The Supplier’s performance of obligations will be considered suspended for the period during which force majeure events occur. In case of force majeure, the performance of the Service will be suspended. This suspension may last for a maximum period of 3 (three) months, after which the parties may decide whether to proceed or cancel the contract.

ARTICLE 17 PROCESSING OF PERSONAL DATA

The Personal Data provided or acquired will be subject to Processing based on the principles of fairness, lawfulness, transparency and protection of confidentiality in accordance with current regulations. The Provider, as the Data Controller, processes Users’ Personal Data by taking appropriate security measures to prevent unauthorized access, disclosure, modification or destruction of Personal Data. Processing is carried out by means of computer and/or telematic tools, with organizational methods and logic strictly related to the indicated purposes. The User’s Data are collected for the execution of pre-contractual measures; to fulfill the obligations arising from the stipulated contract; for the registration procedure aimed at the purchase of the Services; to follow up on specific requests addressed to the Owner by the User; to send promotional and commercial information and offers also through the newsletter service on the basis of the consent freely expressed by the User; for soft spam purposes for promotional communications having as object the purchased Services without the need for the express and prior consent of the User, as provided for by the current regulations. Participants are therefore invited to carefully read the information on the processing of personal data (Privacy Policy) made pursuant to EU Regulation 679/2016, as well as on the use of cookies with the relevant consent to processing where required (Cookie Policy).

ARTICLE 18 DISPUTE RESOLUTION
